TREAD ATHLETICS | SERVICE AGREEMENT

- Service Term & Structure. This service agreement is for one (1) year of access to training services. The Athlete receives 365-days of training access, organized into ‘Blocks’ and adapted into and around existing scheduling constraints and progress. The Athlete is expected to train through all seasons, with the service adapting to Off-Season, Pre-Season, and In-Season needs.
- Retainer & Payment. This service is structured as a retainer – a fee paid in advance of services rendered. As a courtesy, Tread provides a financing plan of monthly installments for an elevated fee. These installments function like a lease or financed payment: the Athlete is liable for completing all payments, in-full, regardless of usage or withdrawal from the service.
- Payment Failure & Suspension. If any charge fails, the Athlete has 48-hours to update his or her payment method before services are temporarily suspended. The Tread+ iOS Application will reflect a ‘Limited’ status after 48-hours until payment is remedied. Sustained failure to complete payments will result in revocation of services and loss of access to Tread’s iOS platform.
- Continuous Service & Rate. The rate basis and terms are honored only so long as service remains continuous year-over-year. An Athlete who lapses and later returns will re-enroll at the most current rate basis; prior rates will not be honored after a break in service.
- Deliverables. The Premium Plan includes the following core components:
- Tread+ Access | The Athlete will receive access to our custom app suite that supports the service including Messenger, Task Manager, Video Vault, Programming, Calendars, etc.
- Comprehensive Programming | There will be initial custom buildout based on comprehensive review (incl. Movement Assessment, Exercise Form Check, Mechanical Analysis) that is distilled in personalized Movement, Throwing, Strength & Conditioning, and Nutrition protocols. Quality is limited by the accuracy and detail of the Athlete’s Intake Information. Programming adapts to the Athlete’s evolving needs and will be distributed in ‘Blocks’.
- Dedicated Coach | The Athlete will be assigned to a dedicated Performance Coach or Team that will provide timely support for his or her evolving development needs. Tread aims for continuity but does not guarantee the same coach throughout the service. If a coach becomes unavailable or is not a fit, Tread will transfer the Athlete to another coach at its discretion to maintain continuous service. The Athlete also has access to Support for administrative needs (billing, card updates, in-house requests, access extensions) via the ‘Request’ feature or direct chat in Messenger.
- Timely Service | Tread is committed to specific timelines to ensure service quality including:
- 48-business-hour response on chat messages
- 72-business-hour preparation of new programming blocks (including the initial buildout) and programming modifications.
- At least one (1) video analysis monthly (up to weekly on request), as requested by the Athlete.
- At least one 20-minute audio/video call monthly (up to weekly as scheduled by the Athlete), as scheduled by the Athlete.
- Operating Hours. Standard hours are 9:00 AM – 6:00 PM Eastern Standard Time, Monday – Friday, plus a 2-hour Saturday block to support remote Athletes. Tread is closed on July 4th, Labor Day, Thanksgiving Day, December 24th, Christmas Day, December 31st, New Year’s Day, and Coaches’ Day; messages on those days receive a next-business-day response. The Performance Staff also receive PTO; the Athlete will be provided adjusted access to message dedicated Tread Staff for support during this time. Operating Hours are subject to change as business needs evolve.
- Materials & Intellectual Property. All plans, private access, and materials are for the Athlete’s use with Tread Athletics only and are not for redistribution or resale. Using Tread-supplied resources to train other athletes is prohibited and will result in termination and corresponding action.
- Parent / Guardian Provisions. Tread welcomes open communication with parents, but once the program begins, prefers that questions about execution come from the Athlete, as parent-driven contact tends to shift responsibility away from the Athlete. Parents have a dedicated web portal to review activity, programming, and progress and to engage with the coach and Athlete Support.
- Refund Policy. Due to the substantial onboarding and plan-creation effort, as well as operating overhead, no full or partial refunds are offered once service has begun.
- Injury Policy. Injuries, while mitigated through proactive programming, can occur. If an injury results in missed training time, billing continues on the scheduled cadence and Tread will extend complimentary access for up to 30 days upon receipt of a physician’s signed note. Continued training with modifications is expected through both non-surgical and surgical interventions. Accounts and billing are not placed on hold during this time. If an injury is career-ending, the Athlete should submit an inquiry to Tread Support.
- Illness Policy. If an illness results in missed extended training time, billing continues on the scheduled cadence and Tread will provide a one-time, complimentary 7-day extension of access upon request to Athlete Support.
- In-House Training. Training at Tread HQ is exclusive to active remote athletes; in-house fees are in addition to base remote fees. A training week is up to 6 days (Sundays off). In-house slots are limited and all in-house fees are non-refundable. Holiday periods have adjusted and open-gym hours, and access to the assigned coach is not guaranteed on-site. Requests must be placed with Athlete Support before reserving a spot.
- Event Participation. Participation in Tread-sponsored events (e.g., Amateur and Free Agent Pro Days) is by invitation only and requires qualifying metrics. Premium status does not guarantee participation; Tread reserves the right to limit participation based on qualifying metrics and availability.
- Service Termination.
- Tread-initiated. Tread may terminate this Agreement without notice for infractions including, but not limited to, athlete noncompliance, abuse of services, theft, physical altercations, redistribution of materials, drug use, and criminal complaint or conviction.
- Coach Transfers. Reassignment to a new Performance Coach is not a qualifying event for the Athlete to terminate this Agreement.
- Service Conflicts. Conflicts with team-related programming are not a valid basis for failing to uphold this Agreement; Tread accommodates team-related restrictions.
- Charge Disputes. Disputing a charge through the Athlete’s bank does not relieve the Athlete of contractual obligations. Tread will contest any such dispute through the processor’s arbitration process and retains a rightful claim to the full retainer value agreed at the start of service. Failing to fulfill the payment obligations may result in being sent to debt collections.
- Early-Termination Fee. Based on the Athlete’s Start Date, early termination fees are tiered as follows:
- Day 1 – 90, one (1) month of active notice plus two (2) months equivalent fee
- Day 91 – 180, one (1) month of active notice plus one (1) month equivalent fee
- Day 181 – 365, one (1) month of active notice
- Athlete understands that Tread has and continues to expend significant resources to support the training services it provides. To mitigate this exposure, there’s a tiered ‘Early Termination Fee’ the Athlete is responsible for when amending the commitment retroactively. Upon receipt of this fee, the Athlete is relinquished of his or her responsibilities and will lose access to the iOS Application and training service.
- Financing Party. The individual [e.g. Parent, Agent] financing this 12-month training retainer, if different from the Athlete, has been made aware of and approves all Terms of Service in this Agreement.
